Cowichan Court Ruling
Last August, the BC Supreme Court recognized Aboriginal title to more than 700 acres of land in Richmond—land that has been bought and sold for generations under provincial property laws. The decision confirms that Crown grants and fee‑simple titles cannot, on their own, extinguish or override Indigenous land rights. Beyond the legal implications, the ruling raises fundamental questions about how land development and major investments should proceed in unceded territories.
